The function of tort law is to, decide and put down what is a “legal injury”. A legal injury is an injury or an act of damage which is legally recognized as one in a court of law. Another function of tort law is to define the circumstances and the situations in which a certain individual or body can be recognized as being responsible for causing that harm or damage. The difference between tort law and criminal law is that in the latter the plaintiff is always the State and so the crime is committed against the State. In the former, the person against whom the offense is committed is the plaintiff and the crime is always committed against that person.
There is another important aspect of tort law that must discuss here. This is defining what the “standard of care” should be. This basically means whether or whether not the behaviour is tortious or not. Thus what is determined is whether the person who is injured received the injury because of his own self or is it because of someone else who caused the injury. Another important point in tort law is the question of negligence. When a party who has suffered some form of damage sues the so called “culprit”, the former has to prove in a court of law that the latter was acting negligently and caused the injury, at least, then there will be no compensation awarded to the injured party.
Also, in the field of tort law, injury has a very wide ranging meaning and just does not cover a form of physical injury solely. Injury can be an invasion or violation of an individual in many ways. Basically, an individual's interests have to be violated or injured, in a manner of speaking. These interests often overlap into a number of other law disciplines as well and that includes property rights as well. Again, in terms of economic interests contracts can become a focus of a tort action as well. Thus, in different ways and situations, tort law comes into play. Another situation is the breach of fiduciary duty which comes with situations involving parties which are in a contractual relationship. This is another situation where there is the question of tort law and its application and usage.
